Partner Wayne J. D’Angelo was quoted in the Law360 article “Feds, States Must Clear Regulatory Air On Fracking Rules.” The article discusses the federal hydraulic fracturing rules for public lands finalized Friday by the Obama administration, and how they could overlap or conflict with existing state rules. Mr. D’Angelo commented on the challenge of determining the relationship between two different regulations. “It’s not always the case that you can look at two duplicative regulations and say this one is weaker, and this one is stronger. They are often just different,” he said. “There may not be a mechanism for being able to avoid duplicative, unnecessary standards. What is more protective is not always clear.”
