Partner Steven A. Augustino was quoted in the Law360 article “FCC Enforcement Survival Guide: Perks Of Settling Early.” This article is the second in a Law360 series focusing on the process of Federal Communications Commission enforcement actions. It focuses on the perks and dangers of an early settlement in these investigations. Mr. Augustino commented on the Enforcement Bureau insistence on admissions of liability. “I can imagine situations where an entity is not going to be willing to agree to [an admission], or cannot agree to that because of the collateral implications that will have, for example, class action litigation,” Mr. Augustino said. “As [the Enforcement Bureau] sticks with that [approach] and as they stick with higher fines, it makes it more likely that somebody is going to be challenging their actions.”
