Partner Steven A. Augustino was featured in the Law360 article "FCC Enforcement Survival Guide: Start Of The Inquiry." The article outlines the process following the discovery of a potential violation of a Federal Communications Commission rule. Mr. Augustino stressed the importance of ensuring that a complete investigation is conducted as soon as possible. "Whatever bad information there is going to be [in the investigation], you want to have it [early in the process]," he noted. He also commented on the strategy in responding to a letter of inquiry, "I generally recommend to clients that as part of the response to the LOI or a subpoena, we include a preliminary statement which provides an overview of the issue, the incident, whatever happened and provides the information you feel is necessary to put it in the proper context," Mr. Augustino said. "I do think it's advantageous to put something more than just a straight response to the questions. You do want to tell your side of the story."
