Partner Steven A. Augustino was featured in the Law360 article “FCC Enforcement Hits New Heights With $100M AT&T Fine.” The article outlines the Federal Communications Commission’s notice of apparent liability accusing AT&T of knowingly misleading customers about its unlimited data plan and failing to adequately inform them of a company policy that slows speeds by as much as 90 percent after customers hit a monthly data threshold. Mr. Augustino notes that, “It definitely ups the ante yet again for the Enforcement Bureau.” He goes on to comment on the possibility of additional penalties. “The commission has very broadly suggested that they may impose damages,” he said. “It’s an indication they intend to expand their powers significantly.”
