Partner Paul C. Rosenthal was quoted in the Law360 article “Faulty Jurisdiction Claim Dooms Chinese Steel Duty Suit.” The U.S. Court of International Trade recently extinguished a Chinese steel maker’s bid to get a lower duty rate for its merchandise, ruling that the company pursued its case along incorrect jurisdictional grounds. While the government made the move to toss the case, it was also backed by U.S. companies SSAB Enterprises LLC and ArcelorMittal USA LLC, which have a vested interest in securing high tariffs on the foreign steel goods. ArcelorMittal is represented by Mr. Rosenthal, partners Kathleen W. Cannon, R. Alan Luberda and John M. Herrmann, and associate Melissa M. Brewer. Mr. Rosenthal noted that, “We think it’s the correct decision, and we were surprised that the Chinese producer even appealed it because it’s very obvious that there is no right to appeal the decision at this point.”
