The Law360 article, “Sprint Beats Sanctions In Suit Over Tax Charges,” mentions Kelley Drye partners Joseph A. Boyle, Damon W. Suden and Lauri A. Mazzuchetti for successfully defending Sprint Spectrum as a Judge refused to order sanctions against them in a proposed class action for claims of passing a state excise tax masked as a mandatory tax charge to customers. In the opinion, U.S. District Magistrate Judge Kevin N. Fox rejected plaintiff’s motion, saying that plaintiff has not shown how preclusion of the data is “properly applicable” in the case, noting that he “was on notice that Sprint intended to produce write-off data in support of its claims and defenses.”
