Won’t Rehear Mushroom Co.‘s Duty Payout Row.” The Federal Circuit on Tuesday passed on U.S. producer Giorgio Foods Inc.‘s bid to reargue its request to receive a cut of the anti-dumping duties on imported mushrooms under a now-expired federal law. A split three-judge panel for the appeals court had sided with the government and domestic producer Monterey Mushrooms Inc. in its April decision, concluding that because Giorgio had not explicitly and publicly supported the petition that led to the remedial tariffs, it was ineligible under the Byrd Amendment to receive compensation once the tariffs had been enacted. Monterey Mushrooms is represented by Mr. Coursey and Mr. Luberda.
