Securities and Exchange Commission found that Tilton can’t seek parallel review of her case in district court because she can still obtain meaningful review in the administrative court, that her claim isn’t “wholly collateral” to the SEC case against her, and that the challenge isn’t outside the agency’s area of expertise. John Dellaportas is quoted in the article stating “If anything, today’s decision puts us farther away from the courts rendering the ultimate answer as to whether the SEC’s administrative law judges are constitutional.”
