Plagiarism Today article discussing the recent 2
nd Circuit ruling in
Sohm v. Scholastic.
This decision is critical for the fashion industry as it finds that although the discovery rule must be applied to determine if the claim is barred by the statute of limitations, and it is defendant’s burden to prove that plaintiff knew or should have known about the infringement to bar a claim, the plaintiff may not recover any monetary damages for actions that occurred more than three years prior to the date the lawsuit is filed.
