Courthouse News Service Notes Partner David E. Frulla in Fishermen’s Case Against Wind Energy Project in Nantucket Sound

Frulla and Kelley Drye’s representation of Martha’s Vineyard/Dukes County Fishermen’s Association in its complaint to stop the Cape Wind Energy Project. The wind farm would consist of 130 wind turbines in the Nantucket Sound, Horseshoe Shoal. Fishermen claim the Bureau of Ocean Energy Management, Regulation and Enforcement violated the Administrative Procedure Act by approving the project and wrongfully imposing conditions on the fishermen. They say the requirements of fishing in lanes and hiring extra personnel will drive them out of business. In a separate federal complaint, environmental groups claim the project will kill endangered species.
