Partner August Horvath was quoted in the BevNET article “Red Bull to Pay $13 Million for False Advertising Settlement.” The article discusses the energy drink company’s $13 million settlement of a proposed class action lawsuit that alleged false advertising from its slogan “Red Bull gives you wings” and its claims of increased performance, concentration, and reaction speed. Red Bull says it settled the lawsuit to avoid the cost and distraction of litigation, while maintaining that its marketing and labeling have always been truthful and denying any wrongdoing or liability. August commented that the case featured difficult claims from the plaintiff “as with any class action, there’s a lot to prove before you can get to the end.”
