In the article, "New Pom Wonderful Ads Use Selective Quotes from Judge's Adverse Ruling," the ABA Journal reported the juice maker responded to the ruling by "plucking positive quotes from his opinion and putting them in new ads." An administrative law judge issued a cease-and-desist order, barring the company from making claims that its juice prevents heart disease, prostate cancer or erectile dysfunction. POM responded with a new ad campaign that quotes parts of the judge's ruling, stating POM could promote its juice as healthy. (The new ad however does not quote the judge's ruling that there was insufficient evidence to support the company's implied health claims.)
The article quoted partner August Horvath from his article with Forbes. Mr. Horvath described POM's latest ad campaign as extremely unusual and ill-advised.
