On October 8, 2014 partner Sarah Roller will speak at the Food and Drug Law Institute’s Food Advertising: Claims, Litigation, and Strategies Conference in New York, NY. Ms. Roller’s session, “FDA’s Recent Use of Guidance to Regulate Foods as Drugs:  ‘Good Guidance’ or ‘Jurisdictional Creep’?” will address the growing debate concerning FDA’s recent reliance on guidance rather than rulemaking to address sensitive new regulatory and enforcement policy matters affecting marketers of food and dietary supplement products. This discussion will include FDA’s guidance on medical foods and guidance addressing the conditions under which clinical research studies involving conventional food and dietary supplement products can be conducted without first submitting an Investigational New Drug Application (IND) to FDA.
