On September 28, 2010 partner John J. Heitmann participated in The Foreign Corrupt Practices Act (FCPA) Privacy and Data Security Committee sponsored CLE on Reform of the Electronic Communications Privacy Act ("ECPA"). Mr. Heitmann, co-chair of FCBA Privacy and Data Security Committee, moderated a session titled "ECPA's Wild Ride: 1986 to 2010."  The session explored how ECPA has been implemented and interpreted over its first 15+ years and highlighted coverage gaps, circuit-splits, and related issues raised by growing national security threats and the advent of new technologies and applications such as social networking, online advertising, geolocation and cloud computing - all of which suggest that the time to reform ECPA is now.
