The Capital Markets are in flux and, as usual, the indenture trustees are thrust in the middle. The uncertain market environment leads to many new challenges, highlights and continuing concerns. This presentation will provide an overview of the role of the trustee in the changing economy, examine the resulting dangers and suggest ways to reduce risk. Particular focus will be on high stakes defaults, bankruptcies and activist investors. Other timely areas covered will be unique considerations with structured products, such as CDOs, and up-to-the-minute legislative initiatives affecting trustees and financial institutions.
