Building on the three prior Client Advisories, which assert that President Obama’s environmental team is poised to increase environmental regulation and enforcement to levels unseen over the past eight years, the last part of this four-part series examines several recent judicial decisions across several different environmental areas that have potentially made it easier for both federal andstate governments, and private citizens, to pursue lawsuits against industry. This advisory discusses several recent cases that highlight how the judicial system is being used to hold polluters accountable.
