This article discusses the Federal Trade Commission (FTC)'s recent final revisions to the "Guides for the Use of Environmental Marketing Claims." These Green Guides are instructive on how the FTC views certain types of environmental marketing claims, and the evidence necessary to support such claims to prevent them from being considered deceptive or unsubstantiated. With the release of the final Guides, the FTC is expected to ramp up its enforcement against companies making unsupported "green" claims.
