Kelley Drye has one of the most diverse and dynamic Customs practices in the country - a practice that is an integral part of the firm’s pre-eminent International Trade group. The depth and range of the skills and experience of its lawyers enable the firm to assist clients with all of their import and export activities. In addition, our Customs lawyers participate actively in the processes by which Customs and trade-related legislation and regulations are formulated. We work closely and effectively with all of the relevant congressional committees that have jurisdiction over Customs laws.

Our professionals have substantial experience in every substantive area of Customs law, including: classification; valuation; country of origin and marking; and admissibility, quotas, and other importing restrictions. We regularly advise clients on preferential trade programs (e.g., NAFTA, GSP, CBI, AGOA and Ch. 98), and we routinely assist clients with audits, focused assessments, and compliance reviews. Our attorneys have an outstanding track record representing clients in investigations, penalty proceedings, forfeitures, ruling requests, and protests. In addition, we have expertise in matters involving the foreign trade zones, temporary importation under bond, and bonded warehouses.

Our lawyers have assisted many companies establish Customs compliance programs in response to the Customs Modernization Act's statutory requirement that importers exercise reasonable care. We strive to work with Customs and with our clients to prevent problems from developing. In doing so, we ensure that our clients are able to maximize their duty savings. Moreover, we help clients participate in new Customs initiatives, including C-TPAT, launched in response to heightened post-9/11 security concerns, and the Importer Self Assessment Program.

We frequently appear before all offices of Customs at the local, regional, and national levels and before other federal agencies whose regulations Customs enforces. We have extensive experience before the U.S. Court of International Trade and other federal courts, including courts of appeal that have jurisdiction over Customs matters. We also are involved intimately with international organizations such as the World Trade Organization and the World Customs Organization.
