Dumping, Subsidies, Safeguard Investigations

GES has developed an unsurpassed record of success in international trade investigations before United States government agencies, including the Department of Commerce, International Trade Commission, and the Office of the United States Trade Representative. We have participated in proceedings in all major areas of the U.S. trade law, providing economic, financial and accounting analysis in support of antidumping and countervailing duty (subsidies provided by foreign governments) proceedings, along with the requisite evaluation of economic "injury" of the affected industry. Our senior staff includes several former Department of Commerce and International Trade Commission employees who, since forming GES, have compiled the best won-loss record in these types of trade litigation of any economic consulting firm or law firm.

In the pursuit of successful actions under U.S. trade law, GES conducts industry surveys, target country market and price research, and provides estimates of the extent of unfair pricing practices and subsidies for preliminary evaluation by companies, industry trade associations, or the law firms representing them. When the evidence supports a decision to proceed further, we can draft petitions, present them to the government, and see them through initiation either ourselves, or as part of a legal/economic consulting team. Following initiation of an investigation by the government, we prepare data, provide statistical and analytical support during the government investigation, develop pricing and economic analysis portions of submissions to government agencies, and provide testimony at hearings.

GES has also provided these services to clients who have become involved in dumping or subsidy litigation under the trade laws of other countries. In addition to our extensive representation of U.S. firms, we have assisted domestic companies using the WTO-approved dumping and subsidy procedures in Australia, Japan, Mexico, and Uruguay.
