International Trade and Customs

As one of the largest and most highly regarded international trade and customs practices in the country, Kelley Drye assists clients with a full range of importing and exporting activities. We are experts in protecting domestic manufacturers against unfairly traded goods and helping companies overcome barriers to entry in foreign markets. We have worked with every significant U.S. trade and customs statute, including antidumping, countervailing duty, export control and economic sanctions laws, the Foreign Corrupt Practices Act, the Customs Modernization Act, section 201 (escape clause), section 301 (violations of U.S. trade rights), and section 337 (unfair trade practices).

The International Trade and Customs Practice Group has an excellent success record in antidumping and countervailing duty matters. Our practice extends to all aspects of importing and exporting, ranging from rapid response to crisis situations (such as embargoed goods and penalty proceedings) to counseling on tariff preference programs and compliance with customs and trade regulations. We also help companies with more traditional issues such as classification, valuation, and country of origin. In addition, we are at the forefront of activity involving the World Trade Organization (WTO), North American Free Trade Agreement (NAFTA), and other international agreements. We have defended U.S. companies in trade cases brought in Mexico, South Africa, and various European and Asian countries against U.S. exports.

We take a multi-disciplinary approach with each client, combining our legal skills with the analytical support provided by Georgetown Economic Services (GES), our in-house economic experts. Many members of the GES team are former employees of the key government agencies that oversee trade matters. Given the public policy content of many trade and customs matters, our international trade and customs attorneys work closely with our government relations professionals on issues before the Executive Branch and Congress.
