A grand jury has been considering evidence in the murders of Arlene and Seymour Tankleff. Represented by Barry J. Pollack, a partner at Kelley Drye & Warren, Martin Tankleff, who served 17 years in prison for the murder of his parents was freed in December 2007 after an appellate court overturned his 1990 conviction. The state attorney general's office is serving as special prosecutor to evaluate evidence including that which leads to suspects other than Marty who has consistently declared his innocence.
In the Newsday video above, Mr. Pollack explains some of the prior legal difficulties the Tankleff defense team has encountered over the years in obtaining cooperation for the gathering of exculpatory evidence.
On June 16, 2008, the special prosecutor will announce how he plans to proceed: whether he will seek to re-try Marty, try other defendants, close the case or seek a continuance.
Mr. Pollack has represented Martin Tankleff for more than 12 years.
