Partner James M. Keneally was quoted in an article, "Revised DOJ Guidelines Could Spark New Strategies," published in Law360.
The article discusses the Department of Justice's revised guidelines for corporate fraud prosecutions. It quotes Mr. Keneally as follows: "'Here's the interesting thing, you're still left with the notion of, we the government will be gauging the level of your cooperation,' said James Keneally, partner in the white-collar crime and investigations practice group at Kelley Drye & Warren LLP.
'What it's effectively saying is, we're not going to make you waive, but if you'd like to waive, absolutely feel free to do so. There's still a little bit of an invitation there,' Keneally said."
