Partners James E. Nealon and Steven J. Moore were quoted by IP Law360 in an article, "USPTO Asks Fed. Circ. To Reverse Ruling In Tafas Case." The article covered the U.S. Patent and Trademark Office's request to a federal appeals court to reverse the decision in the Tafas and GlaxoSmithKline case against the USPTO. The lower court's ruling was a major victory for independent inventor, Triantafyllos Tafas, and pharmaceutical company GlaxoSmithKine, in that it voided a set of controversial rules. The agency had claimed the rules were designed to reduce paperwork and increase efficiency. The lower court held that the USPTO's proposed rules were substantive, not procedural, and that the office did not have the authority to make substantive changes to their own regulations.

In the article, Mr. Nealon addressed the USPTO's argument regarding the standard of review and both he and Mr. Moore stated it is unlikely that the controversial rules would be reinstated anytime soon.
