Connecticut Law Tribune published an article by partner Donna L. Wilson and associate Jennifer Best Vickers titled "A New Use for an Old Tort: Courts Force Reluctant Insurers to Cover Public Nuisance Claims."
The article focused on how companies can access coverage under their comprehensive or commercial general liability (CGL) policies to offset public nuisance lawsuits. The article also discussed the different "defenses" insurers employ to deny coverage for public nuisance claims and how the courts have favored policyholders with respect to coverage.
