The Intellectual Property Strategist published an article by associate Alyson B. Danowski titled "Defending Your Client's Domain Name." The article discusses the procedural rules for the resolution of domain name disputes according to the Rules For Uniform Domain Name Dispute Resolution Policy (UDRP) and the three elements of the UDRP that a complainant must prove in order to win a dispute. The article also reviews a World Intellectual Property Organization (WIPO) panel case decided in favor of the respondents. In AngioDynamics, Inc. v. Sensational Serve, a complainant alleged that a domain name "venacura.com" was confusingly similar to the complainants' "well-known mark," "Venacure." In that case, the respondent demonstrated that it had rights and legitimate interests in the domain name and the complainant failed to prove the respondent registered the domain name in bad faith.
