On October 26, 2016, partners Barbara E. Hoey and Mark A. Konkel will present LGBT Rights in the Workplace” at the In-House Innovates East Conference in New York, NY. This panel will examine workplace diversity & discrimination law and how the 2016 election will impact corporate HR policies. With the right to same-sex marriage established, the workplace is likely the next civil rights frontier. While Title VII does not expressly prohibit discrimination against LGBT individuals, the EEOC has won favorable Title VII decisions based on sexual stereotyping” allegations. The DOJ and the OFCCP are also backing such theories, while Congress considers federal legislation protecting the LGBT population. This session will explore the shifting, often controversial, and important landscape for employers as they adapt to new legal challenges, and focus on key questions employers face when balancing obligations to their business and employees.
