Mr. Crotty spoke on the session titled, Drafting Arbitration Clauses: Strategies to Maximize Efficiency and Avoid Court Challenges.” This discussion gave an update on recent Supreme Court decisions concerning agreements to arbitrate, discussed why using model” arbitration clauses or other cut-and-paste approaches can damage your position in a dispute, as well as how to evaluate, in both domestic and international circumstances, options such as venue, language, choice of law, pre-arbitration resolution, choosing arbitrators, procedural rules, preliminary relief, dispositive motions, discovery, sanctions and enforcement of awards.
