Inequitable Conduct Post-Therasense and How It Impacts Life Cycle Planning

13th Annual Maximizing Pharmaceutical Patent Life Cycles Event

Partner Steven J. Moore spoke at the 13th Annual Maximizing Pharmaceutical Patent Life Cycles event, a part of the ACI’s Hatch-Waxman series. The event took place at the New York Marriott Downtown from October 10-11, 2012. Mr. Moore spoke on the first day of the event, October 10th in a discussion titled, “Inequitable Conduct Post-Therasense and How It Impacts Life Cycle Planning.” The presentation examined the Federal Circuits tightening of the inequitable conduct standard in Therasense, supplemental proceedings under the AIA, the impact on life cycle planning strategies, as well as the repercussions of this ruling and its impact for future inequitable conduct filings. Mr. Moore was joined in this discussion by Patricia Carson of Kirkland & Ellis.
