Bankruptcy Discharge for Environmental Cleanup Obligations? The Impact of U.S. v. Apex Oil

Partner Michael E. Rigney participated in an American Bar Association live audio webcast on February 17, 2010. The CLE session, titled “Bankruptcy Discharge for Environmental Cleanup Obligations? The Impact of U.S. v. Apex Oil,” focused on the evolving case law at the intersection of bankruptcy and environmental policy. Mr. Rigney and other panelists discussed lessons learned from the case for those representing potentially responsible parties that are bankruptcy debtors or nondebtors, how the case is likely to impact governmental strategies for compelling cleanup of contaminated sites, and examine the questions that remain unanswered following Apex. Kelley Drye filed an amicus brief in the Seventh Circuit on behalf of Atlantic Richfield Corporation (BP), Equilon Enterprises LLC d/b/a Shell Oil Products U.S. and Sinclair Oil Corporation in the Apex case.
