Making Sense of the FCC's Network Neutrality NPRM

On October 22, 2009, the FCC released a notice of proposed rulemaking (NPRM), and requested comments on six proposed network neutrality rules and a number of topics relating to the challenge of preserving a “free and open” Internet. Although the Commission does not make any tentative conclusions, the tone of the NPRM – as well as the Democratic majority that supported it – suggests that the Commission will indeed implement some network neutrality regulations. Join Kelley Drye for an insightful discussion of the proposed rules, how they might impact your business, and what you can do about it. The topics we will explore include:
  • How the proposed rules might apply to wireless, VoIP and other IP-based providers
  • The tension between the “nondiscrimination” rule and “special” or “managed services”
