Michele Hallowell is an associate in the firm’s Washington, D.C. office. Her practice focuses on commercial, regulatory, and litigation counseling in the fields of corporate, real estate, environmental, fisheries, and natural resource law. Ms. Hallowell utilizes her strong technical and scientific background to counsel clients in developing lobbying, regulatory compliance and litigation strategies on a variety of technical- and science-based issues, and has extensive experience in the firm’s administrative fisheries practice. She also focuses on transactional counseling regarding real estate interests and industries involved in pharmaceutical, biopharmaceutical, and biotechnical research and medical diagnostics for which she routinely negotiates medical research and service contracts.

During law school Ms. Hallowell interned for the Honorable Kermit Lipez of the United States Court of Appeals for the First Circuit and served as a clerk for the Honorable Joseph H. Field of the State of Maine District Court in West Bath. Prior to law school Ms. Hallowell served as a research assistant for the Boston College Department of Geology and Geophysics where she focused on geochemistry regarding ocean water composition and geomorphology regarding riverbed substrate and its effects on native Atlantic salmon populations. She also worked for Yale University’s Department of Therapeutic Radiology as a Bristol-Myers Squibb Research Intern where she helped develop alternative cancer screening methods. The results of her work have been published in Clinical Cancer Research.

Prior to joining Kelley Drye, Ms. Hallowell worked as in-house counsel for the Maine Lobstermen’s Association where she spearheaded the Association’s engagement in complex regulatory issues at the state and federal level, including the New England Fisheries Management Council and the State of Maine Legislature.

Representative Experience

Conducts technical and non-technical due diligence in real property acquisitions, infrastructure projects, and other commercial transactions.

Performs due diligence in multi-state commercial property acquisitions, including lease and service contract abstracts (and related research issues).

Conducts environmental reviews for the acquisition of natural resource rights.

Assesses legacy liability associated with past operations at acquired real properties.

Serves as legal counsel to an oil company that is a potentially responsible party in defense of an EPA Administrative Order seeking remediation and national resource damages at Newtown Creek.

Negotiates and performs legal review of all clinical trials contracts on behalf of internationally recognized reference clinical laboratory service provider.

Oversees team of attorneys performing legal review of standard contracts on behalf of internationally recognized laboratory service provider.

Served as technical liaison for a group of generator and owner potentially responsible party defendants at a major Superfund site in New York City.

Represents corporate clients and trade associations regarding all aspects of Resource Conservation and Recovery Act (RCRA) and Comprehensive Environmental Response, Compensation, and Liability Act (CERCLA) actions, including proceedings at major Superfund sites.

Represents international shipping trade associations on domestic environmental requirements.

Represents fisheries clients and fisheries trade associations in proceedings regarding ocean wind energy development before the Department of the Interior’s newly created Bureau of Ocean Energy Management.

Represents fisheries clients and fisheries trade associations in all aspects of regulatory and statutory development and litigation regarding the Magnuson-Stevens Fishery Conservation and Management Act and Fisheries Management Councils.
