Lee Istrail is an associate in the firm's Washington, D.C. office. His practice concentrates on antitrust, consumer protection and advertising. His antitrust work focuses on counseling and litigation involving horizontal restraints, monopolization, compliance, distribution and Hart-Scott-Rodino compliance.

Mr. Istrail has filed Hart-Scott-Rodino pre-merger notification submissions and performed competitive analyses on behalf of domestic and foreign entities, including industrial corporations and financial companies, in industries ranging from ethanol production facilities to consumer packaged goods to medical devices and pharmaceutical products.

Mr. Istrail has worked to prepare economic experts for depositions concerning antitrust and damages analyses.

Mr. Istrail also represents companies in consumer protection cases, including the Federal Trade Commission's enforcement of the Do Not Call Registry.

Mr. Istrail has managed electronic production of responsive documents, including Electronically Stored Info (ESI), and the electronic review of production received from opposing parties and non-parties pursuant to subpoenas.

Prior to joining Kelley Drye, Mr. Istrail's experience includes a clerkship in the Office of Policy Planning at the Federal Trade Commission, where he conducted statutory interpretation and quantitative analysis regarding professional licensing restraints, class action litigation reform and predatory lending, and an internship with the House of Representatives Subcommittee on Criminal Justice, Drug Policy, and Human Resources. Mr. Istrail also worked at the Federal Reserve Bank of Boston, where he analyzed the impact of bank holding company mergers and acquisitions on competition and on lending to consumers and businesses.
Representative Experience
Assisted an advertiser in securing dismissal of defamation, tortious interference, unfair competition, false advertising and deceptive trade practices counterclaims filed by a competitor in the District of Minnesota.

Representing an advertiser in its antitrust and false advertising lawsuit against a competitor in the District of Minnesota.

Assisted India's then-largest pharmaceutical company in obtaining antitrust clearance for its sale of a majority stake to Japan's then-second largest pharmaceutical, in a deal valued at $3.4 to $4.6 billion.

Assisted a manufacturer and wholesaler of industrial gases in obtaining antitrust clearance for its acquisition of another wholesaler.

Assisted a global financial services company in obtaining antitrust clearance to acquire a controlling interest in a U.S. based producer of clean-burning ethanol.

Assisted a foreign coffee company in obtaining antitrust clearance to acquire a large U.S.-based coffee company for approximately $220 million.

Assisted the stockholders of a leading designer and manufacturer of orthopedic devices, in obtaining antitrust clearance for its proposed sale to a global medical device company, for approximately $290 million.
