Joe Wilson is special counsel in the firm’s Washington, D.C. office. His practice focuses on business litigation in federal and state courts. He regularly practices in the United States District Court for the Eastern District of Virginia, Alexandria division. Known as the “Rocket Docket,” that court is one of the fastest moving federal courts in the country and has unique local rules and practices.

Mr. Wilson was law clerk to the Honorable Gregory E. Mize (retired), The Superior Court for the District of Columbia. While in law school, he served as a judicial extern to the Honorable Judge Thomas F. Hogan of the United States District Court for the District of Columbia.

Mr. Wilson has authored a client advisory discussing changes in the Federal Rule of Civil Procedure as they relate to the discovery of electronic evidence and the potential ramifications of those for Kelley Drye clients. He has also prepared and conducted seminars addressing discovery in Federal and state courts. Those seminars have addressed issues that businesses face with respect to electronic discovery and records retention strategies for effectively meeting those challenges.
Representative Experience
Intellectual Property Litigation
Served as lead associate on team that defended a large provider of government IT products in a highly-publicized corporate espionage case. The client’s competitor had sued the client and some of its officers for theft of trade secrets and violation of federal Computer Fraud & Abuse, RICO and copyright statutes. Kelley Drye successfully obtained dismissal of 10 of the 13 claims asserted against the client and was able to force the plaintiff to withdraw its motion for preliminary injunction unilaterally. The case ultimately resulted in a settlement in which the plaintiff and our client dismissed all claims and counterclaims and entered a strategic partnership.

Prepared the affirmative and responsive damages cases for client in federal court action involving claims for patent infringement, tortious interference with contracts and other business torts. In doing this, worked closely with the client’s expert witness to formulate damages theories and calculations. Deposed the opposing damages expert and defended the deposition of the client’s expert witness on damages. The case resulted in a favorable out of court resolution for client.

Lead associate on team representing a leading manufacturer of diesel engine components in patent infringement litigation. Drafted various motions, conducted factual investigation, and prepared witnesses for examination and trial.

Provided litigation assistance to other Kelley Drye attorneys in technology and pharma patent litigations in the United States District Court for the Eastern District of Virginia.

Commercial and General Litigation
Managed case, including development and execution of litigation strategy and preparation of briefs, in serving as lead associate in representation of a client in a tax refund case against the Commonwealth of Virginia. The litigation resulted in a favorable settlement, including a $5.4 million tax refund for the client.

Part of trial team for JPMorgan Chase in billion dollar lawsuit against several insurance companies to collect on surety bonds issued for commodities transactions with Enron. Conducted extensive discovery, including the depositions of insurance company representatives and third parties. Prepared examinations of trial witnesses. This case resulted in a favorable settlement for client which was reached during jury deliberations.

Developed and executed litigation strategy in serving as lead associate in representation of a community bank in various litigations that involved, among other things, breach of development loans and breach of a loan participation agreement.

Represented both companies and employees in various employment disputes, including those involving claims under Title VII, the Age Discrimination in Employment Act, the Americans with Disabilities Act, and for breach of contract and breach of fiduciary duty.

Represented companies in commercial real estate disputes.

Telecommunications Litigation
Served as lead associate for a team representing a foreign telecommunications carrier in a complex RICO and unjust enrichment action involving the fraudulent transmission of phone traffic. Drafted the complaint which survived several dispositive motions. Conducted extensive discovery and motions practice. Client won a multi-million dollar judgment following a favorable verdict in a jury trial.

Drafted summary judgment motion for telecommunications carrier in inter-carrier compensation dispute. The trial court agreed with our argument in the motion on the proper construction of the late payment provision in the opponent’s tariff, and the effect of this was to reduce the client’s exposure on damages by approximately $2 million.

Assisted in variety of litigations on behalf of telecommunications carriers (CLECs) focusing on the defense against consumer fraud charges, the enforcement of interconnection rights, the collection of interconnection charges and challenging the legality of municipal franchise fees.
