Jameson Dempsey counsels wireless, wireline, cable and advanced communications service providers on federal and state privacy, information security, and communications issues. Mr. Dempsey advises clients on regulatory policy and compliance with the Communications Act, the Federal Trade Commission Act, and the numerous other federal and state laws governing telecommunications, privacy, and information security. He is a Certified Information Privacy Professional through the International Association of Privacy Professionals.
A significant portion of Mr. Dempsey’s work involves consumer protection issues, including privacy, information security, disabilities access, and open internet. He helps clients develop privacy-related policies and processes, negotiate privacy and security terms of vendor and customer agreements, respond to data breaches, and otherwise comply with myriad federal and state privacy laws, rules, and guidance. In addition, Mr. Dempsey counsels clients on obligations related to advanced communications services under the Twenty First Century Communications and Video Accessibility Act. He also advises clients on compliance with the FCC’s 2010 and 2015 Open Internet Orders, including by drafting transparency statements and analyzing new product offerings and marketing.
His work also involves advocacy before the FCC on a variety of issues. Mr. Dempsey represents large and small carriers, as well as trade associations and ad hoc coalitions, drafting advocacy comments and appearing in FCC proceedings involving privacy and data security, open internet, Universal Service Fund contribution methodologies, gigabit network deployment and reform of the Lifeline program.
In addition to his compliance and advocacy work, he supports clients facing enforcement actions by the FCC and other state and federal regulators, administrative audits and investigations. Mr. Dempsey also assists clients pursuing commercial transactions, mergers and acquisitions and business organizations in complying with legal and regulatory requirements and obligations, performing regulatory due diligence, obtaining necessary approvals and addressing impediments to the client’s goals and objectives.
Prior to joining Kelley Drye, Mr. Dempsey clerked for the Honorable Roanne L. Mann, M.J., in the United States District Court for the Eastern District of New York.
During law school, Mr. Dempsey served as a summer clerk for Commissioner Robert M. McDowell of the Federal Communications Commission. He also participated in the Brooklyn Law Incubator & Policy Clinic, where he advised early-stage technology and social media companies and led outreach efforts to New York–based start-up incubators. Before law school, he worked in the litigation technology group of an international law firm.
Represented an industry association in the FCC’s Broadband Privacy rulemaking.
Represented a coalition of service providers in the Lifeline Modernization rulemaking, including stakeholder engagement with other industry members, Civil Society and Congress.
Drafted regulatory comments on behalf of an industry association in proceedings involving open internet rules, the Annual Section 706 Inquiry, gigabit network deployment and battery backup power.
Represented a global unified communications provider in an administrative appeal related to Universal Service contributions.
Advised numerous telecommunications carriers on privacy and data security issues related to the Customer Proprietary Network Information, the Telephone Consumer Protection Act, the CAN-SPAM Act, Section 5 of the FTC Act, and state privacy and data security laws.
Prepared privacy policies and terms and conditions for early-stage technology and telecommunications companies.
Advised several clients on obligations related to advanced communications services under the Twenty First Century Communications and Video Accessibility Act.
Prepared and secured approvals of compliance plans and applications for eligible telecommunications carrier designation under the FCC’s Low Income Program.
Defended a Team Telecom site visit probing compliance with National Security Agreements.
Advised clients on Universal Service Fund contribution obligations, including allocation methodologies in the context of international revenues and bundled telecommunications and information services.
