Crystal Skelton is a senior associate in the firm’s Los Angeles office. Her practice includes representing a wide array of clients – from tech startups to established companies – in privacy and data security, advertising and marketing, and consumer protection matters.
Ms. Skelton also helps advertisers and manufacturers balance legal risks and business objectives to minimize the potential for regulator, competitor, or consumer challenge while still executing a successful campaign. Her advertising and marketing experience includes counseling clients on issues involved in marketing to children, interest-based advertising (IBA), telemarketing (including calling/texting practices), environmental marketing, commercial email messages, endorsements and testimonials, food marketing, and alcoholic beverage advertising. She represents clients in advertising substantiation proceedings and other matters before the Federal Trade Commission (FTC), U.S. Food and Drug Administration (FDA), and Alcohol and Tobacco Tax and Trade Bureau (TTB). She also represents clients in advertiser or competitor challenges before the National Advertising Division (NAD) of the Council of Better Business Bureaus. In addition, Ms. Skelton assist clients in complying with accessibility standards and regulations implementing the Americans with Disabilities Act (ADA), including counseling companies on website accessibility, and advertising and technical compliance issues for commercial and residential products.
Prior to joining Kelley Drye, Ms. Skelton practiced privacy, advertising, and transactional law at a highly regarded firm in Washington, D.C. and as a law clerk at a well-respected complex commercial and environmental litigation law firm in Los Angeles, California. Previously, she worked at the law firm featured in the movie “Erin Brockovich,” where she worked directly with Erin Brockovich and the firm’s name partner to review potential new cases.
Provides regular privacy and information security compliance counseling for notable innovative brands. While consumers struggle with a notice and choice structure and have very legitimate concerns on whether data collected for marketing purposes is put to a secondary use, and over the security of the data, even if it is anonymous, Ms. Skelton helps clients achieve reasonable and flexible approaches to privacy that do not stifle innovation while increasing transparency and control for consumers.

Advising clients in developing and auditing telemarketing and non-telemarketing calling/texting compliance programs under the TCPA, TSR, and state laws.
Advises numerous clients on the application of the Americans with Disabilities Act to high-tech devices, such as websites and point of sale card-swipe devices. Ms. Skelton identifies and helps clients address potential compliance gaps to mitigate the risk of exposure and challenge from regulators and class action attorneys. In instances in which clients have received complaints or demand letters, she has helped them to negotiate favorable settlements.

Assisted a major pet food retailer challenge various comparative claims made by one of its major competitors. The challenge resulted in a favorable decision at the NAD.
