Barbara Miller is an associate at the firm's Washington, D.C. office. Her practice focuses on commercial and environmental litigation. Within that practice, Ms. Miller is responsible for all facets of litigation both at the trial and appellate court level, as well as mediation.

Ms. Miller's environmental law practice encompasses both litigating and advising clients on compliance with various environmental laws, such as the Endangered Species Act, the Marine Mammal Protection Act, the Animal Welfare Act, the Convention on International Trade in Endangered Species and the National Environmental Policy Act.

Ms. Miller's commercial litigation experience includes successfully representing and litigating against Fortune 500 companies, telecommunications companies and non-profit organizations, and arguing precedent-setting legal issues of first impression. In her commercial litigation practice, Ms. Miller has litigated a wide range of claims, including breach of contract, fraud, false advertising, various torts and employment discrimination.

Prior to joining Kelley Drye, Ms. Miller was an assistant corporation counsel for the District of Columbia litigating civil rights cases on behalf of the District and, prior to that, she clerked with the United States Court of Appeals for the Eleventh Circuit.
Representative Experience
Lead litigation counsel representing a non-profit organization in two cases in federal courts involving the Endangered Species Act and the issue of licensor liability for takes of protected species under the statute.

International Snowmobile Mfrs. Ass'n. v. Norton, 304 F.Supp.2d 1278 (D.Wyo. 2004)
Lead associate representing snowmobile outfitters and members of the snowmobile industry in a challenge to the National Park Service's decision to ban the use of snowmobiles in Yellowstone National Park. Argued for and obtained preliminary injunction barring implementation of a rule during the litigation that would have been highly detrimental to the clients.

Fund for Animals v. Mainella, 294 F.Supp.2d 46 (D.D.C. 2003)
Represented a non- profit organization intervening in litigation brought against the National Park Service challenging a park management decision with respect to the Delaware Water Gap National Recreation Area. Joined in arguments with the Department of Justice and successfully defeated an emergency motion for a preliminary injunction brought by plaintiffs.

Successfully negotiated numerous settlement agreements beneficial to clients and resulting in the elimination of unnecessary litigation costs.

Lead associate in litigation that established that reverse veil piercing is recognized under Virginia law.
