Mr. Merkl's practice focuses on commercial and complex litigation. He is Chair of the Firm's Attorneys Committee.
 
Representative Experience:
Currently lead counsel for generic pharmaceutical companies in multistate and federal litigation brought by state and federal governments.

Currently represents John Hancock Financial Services Corporation in variety of New York-based financial service litigation.

Currently represents Archdiocese of New York in First Amendment Litigation arising out of Church closings.

Trial counsel for JPMorgan Chase in billion dollar lawsuit against eleven insurance companies relating to surety bonds on commodities transactions with Enron.

Successful defense of State Street Bank in lender liability/fraud actions. Defend judgment at conclusion of discovery.

Represent Gibraltar Insurance Company in connection with complex multimillion dollar construction industry litigation.

Successful defense at trial and on appeal of Hercules Incorporated in multimillion dollar breach of contract action for acquisition of subsidiary by Unisys.

Prosecution of complex fraud/fraudulent conveyance action against reorganized insurance companies.

Successful defense of federal False Claim Act litigation in the health care and defense contract industries.

Successful defense of fraud action including multibillion dollar foreign exchange currency trading for JPMorgan Chase.
